A Guide to Using Music on Twitch: From DMCA Restrictions to Legal Playback Paths

The video streaming service Twitch was created in 2011 and specializes in broadcasting eSports tournaments and gameplay. Despite its narrow specialization, the service's audience is growing rapidly. And it is quite difficult to create quality content without music. After the frivolous use of music on the platform and a huge number of DMCA complaints, the service had to update its rules. Now it is prohibited to use music tracks protected by copyright.

Despite the restrictions, streamers have found many workarounds. One easy way for streamers who don’t want to give up the music is to install a Twitch extension called Spotify Synchronizer. The idea behind the extension is that the streamer syncs their Spotify account with viewers. Simply put, everyone is happy, viewers and the streamer listen to the same music, and the author of the work receives a reward for listening to it.

If the above method, as well as purchasing a license to play music, seem unrealistic and expensive, you can find many music libraries on the Internet where works are available by subscription. Common stock music services include:

Pretzel Rocks;
OWN3D Music;
Monstercat.
These services are not free, music on them can cost from a few cents to tens of dollars.

But even if you don’t want to pay even a few cents, you can always find music on absolutely free services:

Audio Library – Music for content creators.
Some streamers resort to the third option - they turn on very quiet music, constantly talking and/or add special effects. This allows them to "confuse" the software that monitors the use of copyrighted content.

What happens if you put any tracks
For copyright infringement on Twitch, streamers who have not sent a counterclaim wordpress web design agency to the copyright holder of the music receive strikes. As a rule, the punishment is the removal of audio tracks that were illegally used or the complete removal of the stream where this music was used. The platform also reserves the right to ban streamers who maliciously violate the rules of the service.



In general, there are no restrictions on the reproduction of any musical content on Twitch. The DMCA rules only protect those works that are protected by copyright.

The following categories of music can be played on Twitch without any restrictions and without a contract:

works created by you;
music that you have purchased a license to play;
works that can be downloaded through the Soundtrack by Twitch library.
There is also music that you can include in your stream that is in the public domain, such as the song "Happy Birthday."

The list of music that is prohibited from being played on the video streaming service is much wider:

radio style music shows;
karaoke;
DJ sets;
perform covers;
visual reproduction of musical works is prohibited, that is, it is not possible to show song lyrics or musical notations;
Singing to a soundtrack is prohibited.
It is also prohibited to reproduce individual fragments of musical works, TV and radio broadcasts. Naturally, these restrictions apply to those musical works that are protected by copyright.

What are the reasons for the restrictions?
According to the DMCA (USA), it is forbidden to upload music content that is not owned by the author of the work or that the streamer has not purchased a license to broadcast. Twitch is owned by Amazon, so it is forced to comply with US law across the platform, regardless of the country the streamer is from.

Twitch, in order to avoid million-dollar lawsuits and controversial situations, is obliged to process notifications of detected copyright violations. At the same time, all disputes regarding content are resolved exclusively between the copyright holder and the streamer (user of the content).

How to choose the right track for your stream
In order not to break the law and not to get your account banned on Twitch, it is better to use music from free libraries, stock compositions. And if you have enough talent and persistence, it is best to play your own music and perform your own songs, which should attract even more subscribers.
